Welcome to SoulNode. These Terms of Service ("Terms") govern your access to and use of the website and services provided by SoulNode LLC, a Wyoming limited liability company ("SoulNode", "we", "us", or "our").
1. Acceptance of Terms
By using any SoulNode services, you agree to these Terms. If you are using the Services on behalf of an organization, you agree to these Terms for that organization.
2. Provision of Services
SoulNode provides information technology services, including Virtual Private Servers (VPS) and related infrastructure. We reserve the right to modify services at any time.
3. Account Responsibilities
- You are responsible for maintaining the security of your account and password.
- SoulNode LLC is not liable for any loss resulting from unauthorized access to your account.
4. Acceptable Use Policy (AUP)
Prohibited activities include:
- Spamming: Sending unsolicited bulk emails.
- Abuse: Hosting malware, botnets, or engaging in DDoS attacks.
- Intellectual Property: Violating DMCA or trademark laws.
- Resource Abuse: Excessive use that impacts other customers.
5. Payment and Refund Policy
- Subscription: Services are billed monthly or annually.
- Special/Promotional Offers: All "Special Offer" or "Promotional" VPS plans are NON-REFUNDABLE.
- Standard Plans Refund Eligibility: For standard-priced services, you may request a refund within 24 hours of purchase, provided that total data usage does not exceed 10 GB and the assigned IP address is in normal status.
- Processing Fees: Approved refunds are subject to payment gateway processing fees.
- Abuse Violation: No refunds will be issued for services suspended due to AUP violations.
6. IP Address Policy
SoulNode ensures that assigned IP addresses are clean at delivery. Report a blocked IP within 1 hour for a free replacement. Subsequent IP blocks due to customer activity are not SoulNode LLC's responsibility.
7. Limitation of Liability
SOULNODE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR DATA.
8. Data Backups
Customers are solely responsible for maintaining their own data backups. SoulNode LLC does not guarantee data integrity or recovery after hardware failure or service suspension.
9. Governing Law
These Terms are governed by the laws of the State of Wyoming, USA.
